By accessing and using the services provided by GetGiven, you agree to be bound by these TOS & our Privacy Policy. If you do not accept these terms & privacy policy, you must not use our services.

GetGiven provides a suite of tools designed to create & host giveaways with ease. The use of our services is governed by this TOS.

3. Use of Service

3.1 License

GetGiven grants you a non-exclusive, non-transferable, limited license to use our services for your personal or business needs, subject to these terms.

3.2 Lawful Use

You agree to use the services only for lawful purposes and in a way that does not infringe upon the rights of others or inhibit their use of the services.

4. User Conduct

When using GetGiven, you agree not to:

• Upload or share content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
• Use the service in any way that violates applicable laws or regulations.
• Attempt to reverse-engineer, hack, or otherwise compromise the security or functionality of the platform.

You are responsible for all actions and content associated with your account.

5. Intellectual Property

5.1 Ownership

You retain ownership of any content you upload or create using GetGiven's services. By using our platform, you grant us a non-exclusive, royalty-free license to use, reproduce, and display your content solely for the purpose of providing the services.

5.2 Proprietary Rights

All software, features, and intellectual property associated with GetGiven remain the sole property of GetGiven. Unauthorized use of our intellectual property is prohibited.

6. Termination

We reserve the right to terminate or suspend your access to GetGiven without notice if you breach these TOS or engage in activities that harm our services or reputation.

7. Refund Policy

All sales are final. Refunds are not provided, as outlined in our Refund Policy. Please ensure you understand this policy before making any purchases.

8. Promotional Communications

By registering for a GetGiven account or entering a giveaway hosted on GetGiven, you consent to receive marketing, promotional and product update emails from us at the email address associated with your account, for as long as your account remains registered with us. This includes emails about new features, offers and marketing campaigns.

If you no longer wish to receive these communications, you can delete your account at any time from your account settings page (Dashboard › Settings › Danger zone), which ends all marketing emails from us. Where required by applicable law, you may also opt out using the unsubscribe link included in our emails.

9. Disclaimer of Warranties

GetGiven’s services are provided "as is" and "as available." We make no guarantees that the service will meet your requirements or function without interruptions, errors, or vulnerabilities.

10. Limitation of Liability

To the fullest extent permitted by law, GetGiven is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the service.

11. Changes to Terms

We may update these TOS at any time. Changes will be effective upon posting on our website. Continued use of GetGiven signifies your acceptance of the updated terms.

12. Governing Law

These TOS shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes will be resolved exclusively in the courts of the Netherlands.
